Certain information may be required to respond to an enquiry, assess a candidate, perform a mandate, comply with law, conduct due diligence or conclude a transaction. Failure to provide required information may prevent ACG from providing the requested service or progressing an application or opportunity.
7. Consequences and recipients
Information may be disclosed to authorised clients, employers, candidates, buyers, sellers, advisers, verification providers, technology providers, regulators or other recipients where necessary and lawful. Candidate information will not ordinarily be introduced to a client without appropriate authority. Confidential seller or buyer information will not ordinarily be shared without authority and an appropriate process.
8. Cross-border transfers
Information may be processed outside South Africa by approved technology or service providers where lawful safeguards are in place as contemplated by POPIA.
9. Retention and security
ACG retains information for lawful operational, contractual, regulatory and dispute-management purposes and applies reasonable technical and organisational security measures. Information is destroyed, deleted or de-identified when it is no longer required and no lawful basis for retention remains.
10. Rights of data subjects

- Request correction or deletion where permitted.

11. Automated decision-making

Electronic marketing will be conducted only where permitted by applicable law. Every marketing communication will provide a reasonable method to opt out. Opt-out requests will be respected and recorded.
